On December 3, 2024, Tennessee Firearms Association and Tennessee Firearms Foundation joined Gun Owners of America, Inc., and several others in an amicus brief that was filed in the United States Supreme Court in the appeal by Smith and Wesson in a case filed by the country of Mexico against Smith and Wesson.
The appeal arises in a civil action where the country of Mexico filed suit in Massachusetts against seven
manufacturers of firearms and one company that distributes firearms from manufacturers to FFLs that
in turn sell firearms to consumers across the nation. The district court applied the provisions of the Protection of Lawful Commerce in Arms Act to reject Mexico’s claims. Mexico appealed to the First Circuit and claimed that these manufacturers and the distributor “aided and abetted” crimes that were committed by Mexican drug cartels but somehow aiding the trafficking of firearms to these cartels. The First Circuit Court of Appeals sided with Mexico and reversed the trial court. Smith and Wesson, and others, appealed.
The amicus brief opposes the decision of the First Circuit Court of Appeals and asks the Supreme Court to dismiss Mexico’s lawsuit.
